Personally Identifiable Information ("PII"): This refers to information that lets us know the specifics of who you are and grant access to the Site. We do not knowingly collect any information relating to third parties which you do not have permission to provide.
When you engage in certain activities on our Site, such as sending us an email to info@utternik.com, we will ask you to provide certain PII.
Aggregate Information: This refers to information that does not by itself identify a specific individual (non-personally identifiable information). We gather certain information about you to enable UTTERNIK’s networking, search, and any rewards features. We also gather certain information about you based upon your use of the Site, where you visit on our Site, and what other sites may have directed you to us.
This information includes, but is not limited to: user gender, year of birth, user’s current city and city of residence, user’s state location and state residence, information about your computer, your computer's IP address, technical information about your computer or device (such as type of device, web browser or operating system), your preferences and settings (time zone, language, privacy preferences, product preferences, etc.), the URL of the last web page you visited before coming to our Site, the buttons, controls and ads you clicked on (if any), how long you used the Site and which services and features you used, and your online or offline status of the Site. This information, which is collected in a variety of different ways, is compiled and analysed on both a personal and an aggregated basis. This information may include the Website’s Uniform Resource Locator ("URL") that points to the site you just came from, which URL you go to after visiting our Site, what browser you are using, and your Internet Protocol ("IP") address.
We do not collect any PII about you unless you voluntarily provide it to us or consent to the sharing of your PII. However, you may be required to provide certain PII to us when you elect to use certain services available on the Site.
We will primarily use your PII to provide information for you. We will also use certain forms of PII to enhance the operation of our Site, improve our internal marketing and promotional efforts, statistically analyse Site use, improve our services, and customize the Site’s content, layout, and services. We may use PII to deliver information to you and to contact you if you request that we do so. We will not sell, trade, or rent your PII to others. We do provide some of our services through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may need to use some PII in order to complete tasks and enable functionality, perform tasks between our respective sites, or to deliver services to you. For example, we use Service Partners to facilitate and complete electronic transmission of data between users conducted with the Site, and to assist us in delivering our electronic communications to you and to analyse Aggregate Information.
We will choose Service Partners who adopt and promote strong privacy policies. However, the use of your PII by our Service Partners is governed by the respective privacy policies of those providers and is not subject to our control.
We may also share the Aggregate Information from or about you with third parties for marketing research, advertising, and to facilitate the display of targeted advertising.
Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Any other sites accessible through our Site or linked or referenced through the Site, including those of our Service Partners, have their own privacy policies and data collection, use, and disclosure practices. Please consult each site's privacy policy. We are not responsible for the policies or practices of third parties.
Other than our Service Partners, we do not allow third parties to collect PII about you or your online activities when you use our Site.
Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
Pursuant to California Civil Code Section 1798.83, you have the right to request deletion of your information from the Application and from Service Providers. UTTERNIK shall not be required to comply with a request to delete your personal information if it is necessary for us to maintain the consumer’s personal information in order to:
i. Complete the transaction for which the personal information was collected, provide a good or service requested by the consumer, or reasonably anticipated within the context of a business’s ongoing business relationship with the consumer, or otherwise perform a contract between the business and the consumer.
ii. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
iii. Debug to identify and repair errors that impair existing intended functionality.
iv. Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
v. Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the California Penal Code.
vi. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the businesses’ deletion of the information is likely to render impossible or seriously impair the achievement of such research, if the consumer has provided informed consent.
vii. To enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business.
viii. Comply with a legal obligation.
ix. Otherwise use the consumer’s personal information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

Pursuant to California Civil Code Section 1798.120, as a user, you have the right, at any time, to direct any business that sells personal information about the consumer to third parties not to sell the consumer’s personal information. This right may be referred to as the right to opt out.
A business that has received direction from a consumer not to sell the consumer’s personal information is prohibited from selling the consumer’s personal information after its receipt of the consumer’s direction, unless the consumer subsequently provides express authorization for the sale of the consumer’s personal information. We do not sell any users’ personal information. Pursuant to California Civil Code Section 1798.125, we will not discriminate against a consumer because the consumer exercised any of the consumer’s rights under this statute, including, but not limited to, by:
i. Denying goods or services to the consumer.
ii. Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
iii. Providing a different level or quality of goods or services to the consumer.
iv. Suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.
Nothing in this subdivision prohibits a business from charging a consumer a different price or rate, or from providing a different level or quality of goods or services to the consumer, if that difference is reasonably related to the value provided to the consumer by the consumer’s data.
Moreover, a business may offer financial incentives, including payments to consumers as compensation, for the collection of personal information, the sale of personal information, or the deletion of personal information. A business may also offer a different price, rate, level, or quality of goods or services to the consumer if that price or difference is directly related to the value provided to the consumer by the consumer’s data. A business that offers any of these said financial incentives shall notify consumers of the financial incentives pursuant to California Civil Code Section 1798.135. A business may enter a consumer into a financial incentive program only if the consumer gives the business prior opt-in consent pursuant to California Civil Code Section 1798.135 which clearly describes the material terms of the financial incentive program, and which may be revoked by the consumer at any time. Despite these terms, a business may not use financial incentive practices that are unjust, unreasonable, coercive, or usurious in nature. We have not disclosed consumers’ personal information for a business purpose in the preceding 12 months absent the user’s request and authorization to share their personal information with our Service Partners. We do not sell users’ personal information.
We believe you should have the ability to access and edit the PII that you have provided to us and collected by us. You may change any of your PII via the Application at any time by accessing the Application. Pursuant to California Civil Code Sections 1798.110 and 1798.115, up to twice a year, you may request:
i. The categories of personal information we have collected about you.
ii. The categories of sources from which the personal information is collected.
iii. The business or commercial purpose for collecting or selling personal information.
iv. The categories of third parties with whom we share or shared personal information.
v. The specific pieces of personal information we have collected about you.
We encourage you to promptly update your PII if it changes. You may ask to have the information on your account deleted or removed; however, some information, such as past cases and transactions, logs of technical support calls, or other information may not be deleted. In addition, it may be impossible to immediately and completely delete your information without some residual information because of backups, but the information will be deleted.
Upon your request, California Civil Code Section 1798.83, known as the “Shine the Light” law, requires us to provide to you (a) a list of your personal information, if any, which we have disclosed to third parties for direct marketing purposes in the preceding calendar year, and (b) the names and addresses of those third parties. You may make such a request once per calendar year, and we will provide the information to you free of charge contingent upon verification of the request. We may, from time to time, send you e-mails and/or newsletters regarding information or services that we feel may interest you. Only UTTERNIK (or agents working on behalf of us and under confidentiality agreements) will send you these notifications. If you do not want to receive correspondence from us, you can “opt-out” by clicking on the “Unsubscribe” link at the bottom of each correspondence.
You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Site may not work properly in your case.
At our Site we make extensive efforts to secure your PII. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII. For example:
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the Site cannot be guaranteed.
You must be at least thirteen (13) years old to have our permission to use our Site. Our policy is that we do not knowingly collect, use, or disclose PII about minor visitors.
You should also be aware that when Personally Identifiable Information is voluntarily disclosed (i.e. your name, email address, third-party website/application account names, etc.) by you through use of the Site, or in other public areas on the Site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages (including unwanted spam messages) from third parties. Such activities are beyond our control and this Policy does not apply to such information.
